Migration policy recommendations contribute to security and stability within the CSTO
The Parliamentary Assembly of the Collective Security Treaty Organization has carried out and continues to carry out work in the area of regulation of migration processes in the Organization’s Member States.
Since 2011, the Assembly has adopted five recommendations in this area of law that contribute to improving the legislation regulating migration processes in the CSTO Member States and observance of the rights of migrant workers.
For instance, in accordance with the 2011–2015 Action Plan, CSTO PA developed and adopted Recommendations on Aligning the CSTO Member States’ Legislation on Combating Illegal (Irregular) Migration and Human Trafficking with the Requirements of Universally Recognized International Normative Legal Instruments.
Recommendations on the Harmonization of the CSTO Member States’ Legislation on the Issues of Refugees and Asylum Seekers adopted in November 2014 are designed to improve national legal systems to address the issues of this category of people.
The CSTO PA Recommendations on the Creation of a Positive Image of Migrant Workers in the CSTO Member States adopted in November 2015 propose a set of measures to improve legislation in five areas:
– expansion of cooperation between the CSTO States in the area of labour migration;
–coordination of approaches and harmonization of migration policy components;
– coordination of actions contributing to the acceleration of adaptation and integration of migrants into the host society;
– strengthening counteraction of manifestations of migrant-phobia;
– improvement of methods and mechanisms for information support of migration policy implementation.
Recommendations on the Improvement of the National Legislation of the CSTO Member States Concerning the Definition of Various Types of Human Trafficking provide a clear and unambiguous definition of this act, as well as ways of using it in the construction and distribution of legal norms providing for liability for human trafficking in the national codes (administrative and criminal).
Recommendations on the Improvement of the National Legislation of the CSTO Member States Regarding Pension Benefits of Migrant Workers (adopted in November 2016) proposed the formation of a system of mutually acceptable guarantees aimed at maintaining the social stability of the Member States. The most important component of this system of guarantees is the organization of cross-border transfer of pension rights of citizens of the CSTO States.
Recommendations on the Improvement of the National Legislation of the CSTO Member States Regarding Undesirable Migration (Blocking the Channels of International Terrorism) are currently being finalized. The purpose of the document is to create a legal mechanism to prevent the growth of the social base of terrorism, limit the movement of terrorists and, consequently, the growth of the terrorist threat in the CSTO States.
