Military personnel training is the focus of the CSTO PA’s attention
This is how the Recommendations on the Harmonization of the CSTO Member States’ Legislation Concerning Military Personnel Training were prepared.
The Recommendations on the Harmonization of the CSTO Member States’ Legislation Concerning Military Personnel Training, adopted by the CSTO Parliamentary Assembly on October 13, 2017, were developed in accordance with the 2016–2020 CSTO PA Action Plan on Approximation and Harmonization of National Legislation of the CSTO Member States.
The Organization States’ legislation in these areas needed harmonization due to a number of factors:
– rather extensive legal regulation of relations in the area of military training in the CSTO Member States;
– insufficient level of legal regulation of certain issues related to the military personnel training in some national laws of the CSTO Member States;
– insufficient or no formalization of the implementation specifics of professional training programmes, including military personnel training, in the national education laws of some CSTO Member States;
– varying terms and definitions (conceptual framework), as well as varying approaches to regulating similar relations in the national laws of the CSTO States regulating the relations in the area of military personnel training;
– extensive legal regulation of relations concerning military personnel training in the CSTO Member States at the level of bylaws, primarily governmental acts of these states.
The draft Recommendations were developed by the Institute of Independent Review and Law (Russian Federation).
On November 24, 2015, April 5 and November 22, 2016 the draft Recommendations were considered by the Expert Advisory Board under the CSTO PA Council, they were amended and supplemented. In addition, the Recommendations’ drafter conducted a detailed analysis of the legislation of the CSTO States in this area. On April 19, 2017, the draft Recommendations were reviewed by the meeting of the Expert Advisory Board under the CSTO PA Council, which decided to submit the draft for review of the CSTO PA Standing Commission on Defence and Security.
On April 20, 2017, the draft was reviewed at a meeting of the Standing Commission and sent to the parliaments of the Organization’s Member States for expert review.
Expert reviews were received from the Standing Commission on National Security of the House of Representatives of the National Assembly of the Republic of Belarus; Standing Commission on International Affairs and National Security of the Council of the Republic of the National Assembly of the Republic of Belarus; Office of the Senate of the Parliament of the Republic of Kazakhstan; Committee on International Affairs, Defence and Security of the Jogorku Kenesh of the Kyrgyz Republic; Committee on Defence and Security of the Federation Council of the Federal Assembly of the Russian Federation; and the Committee on Law, Order, Defence and Security of the Majlisi Namoyandagon of the Majlisi Oli of the Republic of Tajikistan.
On September 19, 2017, the draft Recommendations were reviewed again at the meeting of the CSTO Parliamentary Assembly Standing Commission on Defence and Security, and with all additions and amendments, it was submitted for review at the regular plenary session of the CSTO Parliamentary Assembly on October 13, 2017.
