CSTO PA Recommendations on Improvement of Legislation in the Area of Intellectual Property Rights Protection foster effective military and technical cooperation
March 11 in Russia is the Day of Establishment of the Directorate for Intellectual Property Protection, Military-Technical Cooperation and Expertise of Armament and Military Equipment Deliveries. The aim of the Directorate is to:
– exercise the Russian Defence Ministry’s mandate to manage the Russian Federation’s rights to intellectual property intended for military, dual and special purposes under the jurisdiction of the Russian Defence Ministry;
– organize patenting and licensing;
– coordinate activities of military administration bodies during military and technical support of military product supply,
– coordinate the specification and component parts of military products intended for transfer to foreign clients. Services performing similar tasks have been established and operate in the ministries of defence of all CSTO Member States.
On October 30, 2018, the CSTO Parliamentary Assembly adopted Recommendations on Improvement of the CSTO Member States’ Legislation in the Area of Intellectual Property Rights Protection.
The Recommendations were developed by the Institute of Independent Review and Law in accordance with the 2016–2020 CSTO PA Action Plan on Approximation and Harmonization of National Legislation of the CSTO Member States. They were initially developed as Draft Recommendations on Improving the Legislation of the CSTO Member States in the Area of Intellectual Property Rights Protection and Development, Production, Maintenance and Disposal of Weapons and Military Equipment. However, the logic of the development of relations in the process of military and technical cooperation necessitated splitting the Recommendations into two documents.
On April 19, 2017, at a meeting of the Expert Consultative Council, it was decided to split the draft Recommendations into two documents: Recommendations on Improving the Legislation of CSTO Member States in the Area of Intellectual Property Rights Protection and Recommendations on Improving the Legislation of CSTO Member States in the Area of Development, Production, Maintenance and Disposal of Weapons and Military Equipment.
We have already discussed the second of these documents.
Development of the Recommendations took into account provisions contained in international treaties (agreements, protocols) concluded within the framework of the CSTO and the CSTO PA.
To illustrate, here are some of the documents used and taken into account during the development of the Recommendations:
– Agreement on Cooperation of the Member States of the Collective Security Treaty Organization in the Field of Development, Production, Operation, Repair, Modernization, Extension of the Service Life and Disposal of Military Products (10.12.10);
– Agreement on the General Principles for the Establishment of Interstate Scientific and Production Associations in the Collective Security Treaty Organization for the Production of Military Products (10.12.10);
– The Concept of Standardization of Weapons and Military Equipment in the Framework of the CSTO (10.12.10) and approximately ten other agreements and protocols.
